招標公告
北方重工集團有限公司(以下簡稱北方重工)計劃于2019
年9月10日進行公開招標,歡迎具有生產(chǎn)能力、信譽良好、符合招標要求的企業(yè)參標。
一、招標項目
印度馬哈維爾費羅項目生球分布系統(tǒng)。
二、招標項目內(nèi)容及要求
(一)詳見附件。
(二)中標單位按照北方重工要求貨期及交貨地點執(zhí)行。
三、招標時間及報名方式
(一)招標時間、地點
1.招標時間:2019年9月10日;
2.招標地點:北方重工6號樓1樓101會議室。
(二)報名方式:投標人請于2019年9月10日前到北方重工采購總公司報名,具體事宜請與招標聯(lián)系人接洽。
(三)投標保證金
1.投標人在開標前繳納投標保證金20000元整,標書費200元整(標書費不予退還),否則視其投標無效。
2.投標保證金、標書費以電匯或現(xiàn)金方式繳于北方重工財務(wù)總公司。

五、供應(yīng)商的資格要求
(一)投標人須為中華人民共和國境內(nèi)依法注冊的企業(yè)法人或其他組織(具備一般納稅人資格)。
(二)投標人須具備相應(yīng)產(chǎn)品的生產(chǎn)、經(jīng)營、運輸和如期交貨的能力。
(三)投標人具有良好的銀行資信和商業(yè)信譽,沒有處于被責(zé)令停業(yè)或破產(chǎn)狀態(tài),且資產(chǎn)未被重組、接管和凍結(jié)。
六、標書(兩份,一正一副)
響應(yīng)招標的單位于2019年9月10日前,將密封好的投標文件和投標報價單(報價單另打印密封)交于北方重工招標現(xiàn)場,對于遲交的投標文件不予接受。投標文件包括但不限于下列內(nèi)容:
(一)投標函、資質(zhì)承諾書。
(二)營業(yè)執(zhí)照復(fù)印件(加蓋公章)。
(三)法人代表資格證明書和身份證復(fù)印件(加蓋公章)。
(四)委托投標的,提供委托代理人授權(quán)委托書和委托代理人身份證復(fù)印件(加蓋公章)。
(五)在北方重工及其他單位的主要業(yè)績。
(六)投標企業(yè)生產(chǎn)設(shè)備、技術(shù)力量、驗收標準、產(chǎn)品技術(shù)、售后服務(wù)情況說明材料。
七、投標要求
(一)投標人根據(jù)收到的招標文件進行投標,在投標截止日前可書面或電話向招標人查詢有關(guān)情況并要求解釋。
(二)招標文件在發(fā)出后的3日內(nèi),招標人可以對招標文件進行修訂或補充。
(三)投標人應(yīng)按照標書的要求,認真、完整、真實的填寫投標文件及投標人基本情況。
(四)投標文件不得涂改、增刪,如必須修改時,必須由企業(yè)法定代表人簽字或蓋章方為有效。
(五)為確保招標工作的公正性和保密性,防止串標行為的發(fā)生,此次招標采用現(xiàn)場當(dāng)場唱標,招標人多輪議價最終選定中標人的方式進行。
八、合同主要條款
(一)招標會現(xiàn)場約定。
(二)其他事項:
1.除不可抗拒因素,投標人不得單方面終止合同及有關(guān)協(xié)議,遇有特殊情況必須提前一個月通知招標人,否則按違約處理。
2.投標人嚴格按招標人要求組織供貨,經(jīng)招標人驗收、使用達不到質(zhì)量要求,招標人有權(quán)退貨,并由投標人承擔(dān)因此發(fā)生的費用及損失。
3.招標人在交貨期內(nèi)有權(quán)安排具體交貨時間、數(shù)量,并以書面形式通知投標人,投標人承諾服從招標人安排。
4.因投標人原因造成終止供貨,合同履約保證金不予退回,并賠償給招標人造成的經(jīng)濟損失。
九、付款方式
預(yù)付30%貨款,貨到驗收合格支付60%貨款,剩余貨款10%質(zhì)保金一年后30日付清(銀行承兌匯票)。

Green Ball Distribution System生球分布系統(tǒng)
1.General rules總則
1.1 WHEREAS the SUPPLIER has represented to the Purchaser that it has extensiveexperience, skill and expertise in manufacturing pellet equipment of various capacities,and has offered to supply to the Purchaser the major equipment. Further supplier is awareof type of ore to be used in the plant and confirms that design and capacity would besufficient to achieve the desired 90TPH finished Pellet. The supplier also confirms theminimum availability of the machine will be 330 days in a calendar year. Supplier iscapable and desirous of designing, manufacturing, supplying and commissioning of ALLMAJOR EQUIPMENT FOR 600,000 TPA GRATE KILN COOLER TYPE PELLET PLANTas set-forth in this CONTRACT.
鑒于供應(yīng)商已向買方表明其在制造球團礦設(shè)備方面具有廣泛的經(jīng)驗、技能和專門知識,并已向買方提供主要設(shè)備的報價。此外,供應(yīng)商了解項目使用的礦石類型,并確認設(shè)計和產(chǎn)能足以達到所需的90TPH 成品球團礦。供應(yīng)商還確認該設(shè)備具備一年330 天使用能力。供應(yīng)商有能力并希望設(shè)計、制造、供應(yīng)和調(diào)試本合同規(guī)定的600,000 TPA 球團廠的所有主要設(shè)備。
1.2 This CONTRACT is executed in two sets in English Language each of which shall bedeemed as original and the two counter-parts shall constitute one and the sameCONTRACT which shall be sufficiently evidenced for all-purpose by any one executedcounterpart.
本合同以英文為準,一式兩份,每一份均應(yīng)視為原件,雙方應(yīng)構(gòu)成一份合同,任何一份已簽署的合同副本充分證明其適用于所有目的。
1.3 “Commissioning 調(diào)試” shall mean the date when Equipment has beentried successfully for at least 168 continuous hours on full hot load and ithas been established that there is no fault, defect or factor, which could ormay prevent it from being put into production.
指設(shè)備在全熱負荷下連續(xù)試運行至少168 小時,并確定沒有可能或可能阻止其投入生產(chǎn)的故障、缺陷或因素的日期。
1.4 “Good Industry Practice 良好的行業(yè)慣例” shall mean practices,standards, methods, techniques and procedures and the exercise of thatdegree of skill, diligence, prudence and foresight which would reasonablyand ordinarily be expected from experienced international contractor in thepower sector and which, with respect to the any objective may be expected
in the exercise of reasonable judgment to accomplish that objectives in amanner consistent with applicable law, applicable permits, reliability, safety,environmental protection, economy and expediency and taking intoaccount of the location of or meteorological conditions affecting the Site orconditions affecting the grid system.
指實踐、標準、方法、技術(shù)和程序, 技巧,、謹慎和遠見將合理,通常是有經(jīng)驗的國際承包商在電力行業(yè)對任何目標可能在行使合理的預(yù)期判斷,完成目標的方式,符合適用的法律,適用的許可,可靠性,安全、環(huán)保、經(jīng)濟性和方便性,并考慮到地理位置或氣象條件對站點或電網(wǎng)系統(tǒng)的影響。
2.Manufacture 制造
2.1 The Supplier shall manufacture and supply the Equipment in accordancewith the designs and drawings and the quality assurance plan as approvedby the Purchaser or its authorized representative Company in accordancewith this Contract.
供方應(yīng)按照買方或其授權(quán)代表公司根據(jù)本合同批準的設(shè)計、圖紙和質(zhì)量保證計劃制造和供應(yīng)設(shè)備。
2.2 The Supplier shall perform all of its obligations and responsibilities underthis Contract using due care and diligence of a manufacturer ofinternational reputation and standing such as the Supplier, in a professionalmanner, using sound engineering, manufacturing and design principles
such that besides complying with every requirement and obligation set forthin this Contract and all Applicable Law, the Supplier also ensures no part ofthe obligations of the Supplier under this Contract is performed, furnishedor provided in a manner which makes or contributes to making theEquipment less than fully fit for its intended purpose.
供應(yīng)商應(yīng)當(dāng)履行在本合同項下所有義務(wù)和責(zé)任,制造商使用應(yīng)有的謹慎和國際聲譽, 以專業(yè)的方式,通過合理的工程、制造和設(shè)計原則,除了遵守每一個要求和本合同規(guī)定的義務(wù)和所有適用的法律,供應(yīng)商還確保,在履行、提供或提供本合同項下供應(yīng)商的任何義務(wù)時,其方式均不會使或使設(shè)備不適合其預(yù)定用途。
2.3 The Supplier shall along with the manufacture and supply of the Equipment,furnish all data, drawings, documents, manuals and other information for, orrelated to, the Equipment to the Purchaser (“Manuals”) as more specificallydetailed in the General Conditions of Contract. Copies of the Manuals (inEnglish) and other engineering documents (in English) prepared by theSupplier pertaining to this Contract and submitted to the Purchaser shallbecome the property of the Purchaser and the Supplier will have no claimto such drawings and documents for any reason whatsoever. Supplier alsoprovide Basic Engineering drawing in AutoCad for and manual in soft form.
供應(yīng)商應(yīng)在設(shè)備的制造和供應(yīng)過程中,向買方提供設(shè)備的所有數(shù)據(jù)、圖紙、文件、手冊和其他資料(“說明書”),或與之相關(guān)的資料(“說明書冊”),詳見本合同一般條款。供方準備的與本合同有關(guān)的手冊(英文版本)和其他工程文件(英文版本)的副本應(yīng)成為買方的財產(chǎn),供方不得以任何理由要求獲得這些圖紙和文件。供應(yīng)商還提供基本的工程圖紙(AutoCad )、說明書的電子版。
2.4The supply and delivery of the Equipment by the Completion Date shallinclude supply of all Manuals and all other parts, including but notlimited to auxiliaries, commissioning spares, 2 (two) years operation andmaintenance spares (“O & M Spares”), special tools and tackles, and all
other parts / spares as specified in this Contract. The Purchaser or itsauthorised representative Company shall have the right to monitor theSupply Schedule at such frequency as it may reasonably decide andthe Supplier shall provide such updates to the Purchaser as are
required by the Purchaser.

2.5 The Supplier acknowledges that the Equipment is scheduled to becommissioned on or before the Commissioning Date.
供方確認,設(shè)備在調(diào)試日當(dāng)天或之前進行調(diào)試。
2.6 The Supplier shall impart all requisite training to the operation andmaintenance personnel of the Purchaser at the Site and at the Supplier’sworks, free of cost.
供方應(yīng)免費在現(xiàn)場和供方現(xiàn)場對買方的運維人員進行所有必要的培訓(xùn)。
2.7 The Supplier shall follow international practice of packing the consignmentin seaworthy manner to ensure complete safety of the equipment and partstill it reaches its destination. Supplier shall arrange at it’s own cost forloading of Equipment and materials for delivery, into the container / vessel.
供應(yīng)商應(yīng)遵循國際慣例,以適合海運的方式包裝貨物,以確保設(shè)備和部件的完全安全,直到貨物到達目的地。供應(yīng)商應(yīng)自行安排將用于交付的設(shè)備和材料裝入集裝箱/船只。
3.Performance Standards 性能標準
It shall be the obligation of the Supplier to ensure that the Equipment is of bestquality and workmanship according to the latest engineering practice,manufactured from materials of best quality, and strictly in accordance with theTechnical Specifications. The Supplier shall adhere to the standards or codesprescribed by Indian Bureau of Standards unless otherwise specified in thisContract. If no standards or codes are specified, the Supplier shall adopt suchstandards as are prescribed by the Purchaser in this behalf, which shall not beinferior to the aforesaid standards or codes.
供應(yīng)商有義務(wù)確保設(shè)備的質(zhì)量和工藝符合最新的工程實踐,使用最優(yōu)質(zhì)的材料,嚴格按照技術(shù)規(guī)范制造。除非本合同另有規(guī)定,供應(yīng)商應(yīng)遵守印度標準局規(guī)定的標準。如果沒有指定標準,供應(yīng)商應(yīng)采用買方代表其指定的標準,該標準或規(guī)范不得低于上述標準或規(guī)范。
4. DRAWINGS, BILLING SCHEDULE, QAP, MAINTENANCE AND OPERATION
MANUALS 圖紙,清單,QAP,維護和操作手冊
5.1 The Supplier shall, provide to the Purchaser for its review, 3 (six) copies each ofall the General Arrangement Drawings of all equipment in English language (asspecified in the Annexures /Schedules), with complete load data, elevation,detailed Billing Schedule and QAP approved by the Purchaser etc. together withweight and sufficient overall dimension and other relevant details required fordesigning foundations, superstructure and associated equipment within 30 days ofthe date of RECEIPT OF FIRST ADVANCE unless otherwise mutually agreed
between the Parties. Purchaser should give the comments within one week afterreceiving the drawings from supplier.The Supplier shall also provide specificationsfor all equipment and auxiliaries (within the specified battery limits) in thePurchaser’s scope of supply within the same time period. The drawings shouldalso indicate the equipment maintenance platforms, lifting hooks, monorails,embedment, and other details to be provided for proper erection and maintenance.The Purchaser may at its sole discretion suggest any modifications to such
General Arrangement Drawings.
供應(yīng)商應(yīng)提供給買方審查所有設(shè)備的總布置圖紙(英語版本3 個副本),完整的荷載數(shù)據(jù),標高,詳細的清單和QAP 質(zhì)量控制計劃等,在收到第一次預(yù)付款之日起30 天內(nèi)提交設(shè)計地基、上部結(jié)構(gòu)和相關(guān)設(shè)備所需的重量、足夠的總體尺寸和其他相關(guān)細節(jié),除非雙方另有約定。買方應(yīng)在收到供應(yīng)商的圖紙后一周內(nèi)提出意見。供應(yīng)商還應(yīng)在同一時間內(nèi)提供買方供貨范圍內(nèi)的所有設(shè)備和輔助設(shè)備的規(guī)格(在規(guī)定的范圍內(nèi))。
5.2 After the General Arrangement Drawings are reviewed by the Purchaser or theInspector, 1 (one) soft copy and 3 copies of the final Equipment assembly anddrawings in English language, complete with erection tolerances, within 20 daysof such approval unless otherwise mutually agreed between the Parties. Thedrawings shall show clearly the details and exact location of parts, which are to beconnected to the equipment not supplied by the Supplier.
買方審查總布置圖紙,1 份電子版和3 份最終的設(shè)備組裝和荷載數(shù)據(jù)圖紙應(yīng)當(dāng)提供英語語言的安裝圖紙,完成裝配公差,20 天完成批準,除非另有雙方同意。圖紙應(yīng)清楚地顯示零件的細節(jié)和確切位置。
5.3 The Supplier shall provide to the Purchaser, all data or technical informationrequired for Bought outs, starting within 10 days of the date of receive theadvance payment and to be completed within 25 days , unless otherwise mutuallyagreed between the Parties.
供應(yīng)商應(yīng)在收到預(yù)付款之日起10 天內(nèi)向買方提供所需的所有數(shù)據(jù)或技術(shù)信息,并在25天內(nèi)完成,除非雙方另有約定。
5.4 The Supplier shall, where required by the Purchaser, provide schematic electricaldrawings and interconnecting wiring diagrams showing points where electricalconnections have to be provided by the Purchaser within 1 (one) month of thedate of received first advance payment.
如買方要求,供應(yīng)商應(yīng)在收到第一筆預(yù)付款后1 個月內(nèi)提供電氣原理圖和顯示買方必須提供電氣連接點的互連接線圖。
5.5 The Supplier shall, where required by the Purchaser, provide three (3) copies ofthe erection, maintenance, lubrication, operation and spare parts manual inEnglish language within 25 days after received advance payment. The spare partsmanuals shall incorporate information in tabulated from, giving part identificationnumbers, pieces required, material specifications, manufacturer’s name, ordering
details and dimensional sketches and all informations should be in Englishlanguage.
如買方要求,供應(yīng)商應(yīng)在收到第一筆預(yù)付款后25 天內(nèi)提供3 份英文版的安裝、維護、潤滑、操作和備件手冊。備品手冊應(yīng)包含以下信息:零件標識號、所需零件、材料規(guī)格、制造商名稱、訂購細節(jié)和尺寸示意圖,所有信息應(yīng)以英文寫成。
6.PACKING, PROTECTIVE PAINT, MARKING AND SHIPPING包裝、防護漆、標志、運輸
6.1 Packing and Protective Painting 包裝、防護漆
6.1.1 Subsequent to inspecting and verifying the Equipment to be transported anddelivered to the Site, if the Purchaser or the Purchaser’s Representative, as thecase may be, is satisfied that the Equipment so inspected and verified, matchesthe details of the parts of the Equipment, Technical Specifications and the Designsand Drawings, they shall cause the representatives of the Supplier to mark theEquipment and prepare a packing list of the Equipment (“Packing List”) and alsocause the same to be loaded on to the transportation vehicle.
買方或買方代表在檢查和驗證要運至現(xiàn)場的設(shè)備后,如果買方或買方代表,視情況而定,對設(shè)備檢查和驗證滿意,匹配技術(shù)規(guī)范和設(shè)計圖紙,供應(yīng)商的代表應(yīng)準備一個裝箱單,將相同的貨物加載到運輸工具上。
6.1.2 The Supplier shall include and provide for securely protecting and packing theEquipment in accordance with the best industry practices so as to protect thecontents from damage during transit from point of manufacture / supply until afterarrival at the Site under conditions, which may involve multiple handling, transportby ship, rail and road, storage, exposure to heat, moisture, rain etc. and possibilityof pilferage. The packing standards shall be approved by the Purchaser and thePurchaser may check the packing before dispatch and may ask for modifications,to the extent considered necessary, to be carried by the Supplier, at no extra cost
to the Purchaser.

6.1.3 The Supplier shall provide for cleaning, surface preparation, application of primer
and paint etc. according to best industry practices. All metallic surfaces except
bright steel parts shall be given suitable primary coat and 2 (two) coats of best
quality epoxy paint of approved colour in accordance with best industry practices.
供方應(yīng)按照行業(yè)最佳做法提供清洗、表面處理、底漆和油漆的應(yīng)用等。除亮鋼部件外,所有金屬表面均應(yīng)按照最佳工業(yè)慣例涂上適當(dāng)?shù)牡灼岷?/span>2(兩)層環(huán)氧樹脂漆,按批準的顏色施行。
6.1.4 The Supplier shall ensure that heavy equipment are mounted and bolted to skidswhich shall be of sufficient strength to support and prevent distortion to theEquipment. All openings of pipes, large valves and parts shall be protected bywooden covers or plugs and machined threads must be covered by the caps toprotect against damage in transit.
供方應(yīng)確保重型設(shè)備安裝并螺栓固定在具有足夠強度以支撐和防止設(shè)備變形的滑塊上。所有管道、大型閥門和部件的開口都應(yīng)該用木蓋或塞子保護,加工過的螺紋必須用蓋子蓋住,以防止在運輸過程中損壞。
6.1.5 The Supplier shall provide for adequate protection of all Equipment and partssusceptible to corrosion by exposure to moisture, and all electrical equipmentagainst damage during transit and storage. In addition to normal packing, allelectrical equipment shall be wrapped in polyethylene or polypropylene plasticsheet and openings in electrical equipment shall be sealed with water proof tapesand adequate quantity of silica gel or other suitable dehydrating agent shall beused. A protective grease proof shall be inserted between the brushes andcommutators of motors.

6.1.6 The supplier shall deliver the following items in individual separate packages,having markings and connecting parts axis marking, corresponding to theequipments.
供貨商應(yīng)該將以下各項單獨包裝發(fā)運,并且標記在包裝箱各面標記對應(yīng)的設(shè)備
Spares including commissioning spares 調(diào)試備件

6.1.7 Fragile items shall be wrapped in crepe-cellulose wadding or some equally efficientcushioning material, floated in excelsior and packed in substantial woodencovers with special precaution against risk of breakage.
易碎物品應(yīng)用縐紗-纖維素棉絮或其他同樣有效的緩沖材料包裹,漂浮物應(yīng)采用優(yōu)質(zhì)漂浮物,并應(yīng)用堅固的木質(zhì)蓋包裝,特別注意防止破損。
6.1.8 The shipment dimensions of each package shall not exceed the maximumdimensions of packing which can be accepted for transport by road or transport byship and should be informed to the Purchaser not less than 60 days beforepacking for his information. If, however, over-size components are absolutelyunavoidable, the Supplier shall give reasonable advance notice of not less than 30days before packing to the Purchaser for his information.
每個包裝的裝運尺寸不得超過可接受的公路運輸或船舶運輸?shù)淖畲蟀b尺寸,并應(yīng)在包裝前不少于60 天通知買方供其參考。但是,如果絕對不可避免地出現(xiàn)尺寸過大的部件,供應(yīng)商應(yīng)在包裝前至少30 天向買方發(fā)出合理的提前通知,供買方參考。
6.1.9 Notwithstanding anything to the contrary contained anywhere in this Contract, theSupplier shall arrange for the movement of oversize consignment duly obtainingnecessary permission from the concerned agencies and complying with all legaland practical requirements for the same at its cost. The Supplier shall furnish a listof oversize consignment along with dimensional drawings and packing sizes to thePurchaser for his information, within 1 (one) month of the Effective Date.
盡管本合同中有任何相反規(guī)定,供方應(yīng)安排超大號貨物的運輸,并應(yīng)適當(dāng)獲得有關(guān)機構(gòu)的必要許可,并應(yīng)符合所有法律和實際要求,費用由供方承擔(dān)。供應(yīng)商應(yīng)在生效日起1個月內(nèi)向買方提供一份超限貨物清單,連同尺寸圖紙和包裝尺寸,供買方參考。
6.1.10 Each Equipment or parts of Equipment shall, when shipped or dispatched, betagged with reference to the assembly drawings and corresponding part numbers,weight and all other information. 2 years O&M Spare part should be packedseparately and mentioned the details over the packing box. All such informationsshould be in English language.

6.1.11 The Supplier shall also submit the details of Bought out Items being dispatched to
the Site directly for the reference and record of the Purchaser.

6.1.12 The Supplier shall be fully responsible at its cost and expense for any delays,penalties, charges, fines, losses, if any, in connection therewith for the loading /unloading of consignment or of equipment to be directly delivered at the Site orany incremental or increased customs duties relating to any incorrect declarationor inadequate documentation.

6.1.13 Notwithstanding anything stated in this Section, the Supplier shall be entirelyresponsible for loss, damage or deterioration to any Equipment and parts thereofoccasioned by faulty, defective or insecure packing, or due to improper orinsufficient protective measures or due to non-compliance of carriers stipulatedpacking conditions.

6.2 Marking 嘜頭
6.2.1 The shipping marks in English block letters shall be clearly stenciled on theshipping packages with good quality non-fading paint in sufficiently largecharacters as permitted by the size of the package.
以英文正楷書寫的嘜頭,應(yīng)在包裝物上清楚地用優(yōu)質(zhì)不褪色油漆印刷,并在包裝物尺寸允許的范圍內(nèi)以足夠大的字體印刷。
6.2.2 The same set of marking shall appear on all four sides of the packages. It shallnot be necessary to make markings on the top and bottom of the packages. Thefollowing markings shall appear prominently on all the four sides of the packagesin 75 mm (seventy five millimeter) size letters. These are main markings whichshall also appear in the bill of lading :

6.2.3 Apart from the above marking, cautionary symbols, such as “FRAGILE’, “HANDLE

6.2.4 If required by the Purchaser, for the identification of unloading areas at the sitecoloured bands, in the colour codes indicated by the Purchaser or Consultant shallbe painted diagonally on the four sides of all packages, crates or boxes.

6.2.5 In the case of bundles or metal base, the proper markings, as hereinbeforedesignated, shall be placed on metal tags and securely attached to the bundle orbar as conspicuously as possible.

6.2.8 Fabricated parts or sections of structures and Equipment must have theirrespective piece marks permanently stamped into the piece to a depth of not lessthan 1 mm (one millimeter), and the stamped area painted with rust preventivepaint to a radial distance of 50 mm (fifty millimeter) on the surrounding area.

6.3 Packing Lists 箱單
Each package shall have a detailed packing list in English language quotingspecifically the name of the Supplier, number and date of the Contract, the nameof the Purchaser and the detailed list of contents packed within the packageindicating the nomenclature of the items, a schedule of parts for each completeEquipment and the quantity of each part, drawing numbers and the tag numbers.
A duplicate copy of the packing list shall be put in a waterproof steel pouch andfastened securely to the outside of the package as well as to unpacked pieces orbundles. The Packing specifications shall also explicitly indicate the net weight,gross weight, length, width and height and cubic volumes as well as detailedcontents of each package separately. The packages shall have running serialnumbers, which shall also be shown in the bill of lading.

7. WARRANTIES 擔(dān)保
7.1 The Equipment shall carry a warranty for a period of 12 (TWELVE) months fromthe date of successful commissioning or 18 (EIGHTEEN) months from the date ofsupply, whichever is earlier, against any material defect, design defect,manufacturing defect and/or failure of Equipment to perform, as stipulated. Thespares shall carry a warranty period of 12 (TWELVE) months from the date of theirbeing put to use (“Defects Liability Period”).
設(shè)備的保修期為自成功投產(chǎn)之日起12 個月,或自供貨之日起18 個月,兩者以較早者為準。針對任何材料缺陷、設(shè)計缺陷、制造缺陷和/或設(shè)備故障不能按規(guī)定執(zhí)行。備件的保修期為12 個月,自使用之日起計算(“缺陷責(zé)任期”)。
7.2 During the Defects Liability Period, the Supplier shall, at its own expenses, uponwritten demand by the Purchaser, take effective steps for and shall promptly repair,modify or replace defects, deficiencies, or damages, which arise or exist in anypart of the Equipment. If for reasons solely attributable to the Supplier any part ofthe Equipment could not be used pending repairs or replacements for any period,the aforesaid warranty period shall automatically stand extended by the sameperiod for which the Equipment could not be used.
在缺陷責(zé)任期間,供應(yīng)商應(yīng)根據(jù)買方的書面要求,自費采取有效措施,對設(shè)備任何部分出現(xiàn)或存在的缺陷、缺陷或損壞進行及時修理、修改或更換。如果僅由于供應(yīng)商的原因,設(shè)備的任何部分在任何期限內(nèi)無法在修理或更換,則上述保修期應(yīng)自動延長。
7.3 All repairs, modifications and replacements carried out by the Supplier to rectifyany defects, deficiencies or damages shall be made to the satisfaction of thePurchaser. Supplier shall bear all the cost incurred for the replacement.Equipment which is so repaired, modified or replaced shall be guaranteed by theSupplier, for a further period of 12 (TWELVE) months.

8. PATENT INFRINGEMENT 專利
The Supplier shall, whether during the progress of the Contract or afterwards, andwhether before or after the termination, abandonment or breach of contract, fullyindemnify the Purchaser against all omissions, claims, demands, costs, chargesincluding attorney’s fees and other legal costs including all expenses incurredrelating thereto and responsibility, arising from or incurred by reasons of anyinfringement or alleged infringement of latest patent, designs or copy right andshall meet all costs related thereto.

3. Basic structure and composition of equipment

The equipments specified in the scope are designed and manufacturedas per the sellers drawings dually approved by Purchase.The equipment is sturdy and reliable, which can meet productionrequirements and is easy for maintenance. Lubrication is reliable andfree from oil leak.All the Rolls are made of 1Cr18Ni9Ti material and machined . shaft ofroll are made from forged steel .Motors are of cage type of Y series with power voltage of ~415V andControl power supply of ~230V.Nylon liners are used as discharge chute liners. If the Purchaserdesires for anti-wear resistant steel liners, the same to be provided bythe seller at no extra cost.

5.Equipment manufacturing requirements and inspection standardsConstruction drawings, completed by Seller, shall subject to Buyer’s reviewand signing. Only after that, this drawing can be followed for manufacturing.Such works as assembling, test and inspection are then performed in themanufacturing plant.Main technical standards followed during manufacturing: General Technical Specifications on Heavy Machinery (JB/T5000.1~15). Manufacturing, assembling and commissioning of the pelletizer should meetthe requirements of design drawings and documents and be provided withcomplete quality inspection reports. Supervisors for equipment
manufacturing are entitled to check and review quality inspection reportsand relevant documents.

Upon arrival of equipment on site, Seller shall send qualified technicians toinstruct installation. Seller shall repair and replace those defect equipmentemerged during this period within specified period free of charge.

投標函
北方重工集團有限公司:
一、根據(jù)已收到的北方重工的招標文件,投標人研究上述招標文件的投標人須知、合同文本、技術(shù)規(guī)格和其他有關(guān)文件后,投標人愿以報價書中的單價、總價完成招標項目(或者貨物)。
二、投標人已經(jīng)認真閱讀下述投標人須知,并同意按投標人須知的約定進行投標。投標人須知如下:
(一)投標人不得以串通投標、抬標、壓標等行為破壞公平競爭,一經(jīng)發(fā)現(xiàn),其投標和中標無效,并且投標人同意以全部投標保證金作為對本次投標給招標人造成損失的賠償。
(二)投標人不得對招標方的評標人員、監(jiān)標人員以及工作人員有商業(yè)賄賂等影響公平公正評標的行為,一經(jīng)發(fā)現(xiàn),其投標和中標無效,并且投標人同意以全部投標保證金作為對本次投標給招標人造成損失的賠償。
(三)招標人將以書面形式發(fā)出預(yù)中標通知書,預(yù)中標通知書一經(jīng)發(fā)出即發(fā)生法律效力。
(四)在招標人發(fā)出《中標通知書》后2日內(nèi)簽訂合同。
(五)未中標單位的投標保證金在宣布中標單位后的30日內(nèi)退還,不解釋未中標原因,不退回投標文件。
(六)投標人在開標后撤回投標文件,取消其投標資格,并且投標人同意以全部投標保證金作為對本次投標給招標人造成損失的賠償。投標人對投標報價經(jīng)書面確認之后撤回的,投標人同意以全部投標保證金作為對本次投標給招標人造成損失的賠償。
(七)中標人不與招標人訂立合同的,招標人取消其中標資格,并且中標人同意以全部投標保證金作為對本次投標給招標人造成損失的賠償。
(八)如中標人違約,招標人可從其他投標人中重新選定中標人簽訂合同,并且中標人同意以全部投標保證金作為對本次投標給招標人造成損失的賠償。
(九)投標人中標,投標保證金將轉(zhuǎn)為合同履約保證金,合同執(zhí)行完方可退還。
三、我方同意所遞交的投標文件在開標后90日內(nèi)有效,在此期間內(nèi)我方的投標有可能中標,我方將受此約束。
